Welcome to "The Health Nav Limited" ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website www.thehealthnav.co.uk, our mobile application (if applicable), and the services, features, content, and applications offered by us (collectively, the "Services"). Our Services are designed to help you ("User", "you", "your") find and connect with healthcare and wellness practitioners and clinics ("Practitioners").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

The Health Nav Limited provides an online platform that enables Users to search for and find information about Practitioners, including their services, location, and availability (as provided by the Practitioners). Our Services may also allow you to request contact or submit booking enquiries to Practitioners through the platform, subject to the Practitioner's availability and acceptance.

The Health Nav Limited IS NOT A HEALTHCARE PROVIDER AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

The information and content provided through our Services, including information provided by Practitioners in their listings, are for informational and directory purposes only.

You should always seek the advice of your doctor or other qualified healthcare provider with any questions you may have regarding a medical condition or treatment. Never disregard professional medical advice or delay in seeking it because of something you have read or accessed through our Services.

IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD DIAL 999 OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY.

Account Creation: To access certain features of our Services, you may be required to register for an account. When you register, you agree to provide accurate, current, and complete information as prompted by the registration form.

Account Responsibility: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account or any other breach of security.

Eligibility: You must be at least 18 years old and legally permissible for your service to create an account and use our Services. By creating an account, you represent and warrant that you meet this age requirement.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm The Health Nav Limited, users of the Services or Practitioners, or expose them to liability.
• To decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the Services.
• To use any robot, spider, or other automatic device, process, or means to access the Services for any purpose, including monitoring or copying any of the material on the Services.

User Responsibility: Your interactions with Practitioners found through our Services, including any appointments made or services received, are solely between you and the Practitioner. You are responsible for conducting your own due diligence and verifying the credentials, qualifications, and suitability of any Practitioner before engaging their services.

No Endorsement: The Health Nav Limited does not endorse, recommend, or guarantee any particular Practitioner or their services. Listings on our platform do not imply endorsement or recommendation.

Information Accuracy: While we require Practitioners to provide accurate information for their listings, we do not guarantee the accuracy, completeness, or timeliness of any information provided by Practitioners on our platform.

Bookings: Any booking requests or communications made through our platform are subject to confirmation by the Practitioner. We are not a party to any agreement or transaction between you and a Practitioner and have no liability or responsibility for the terms and conditions of the booking or the booked service(s).

Our Content: The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by The Health Nav Limited, its licensors, or other providers of such material and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Limited Licence: These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

Your Content: You retain all rights in, and are solely responsible for, any content you post or submit to the Services ("User Content"). NEITHER The Health Nav Limited NOR ANY PERSON ASSOCIATED WITH The Health Nav MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES OR THE ADEQUACY OF THE PRACTITIONERS OR THE SERVICES THEY PROVIDE.

WITHOUT LIMITING THE FOREGOING, NEITHER The Health Nav Limited NOR ANYONE ASSOCIATED WITH The Health Nav Limited REPRESENTS OR WARRANTS THAT THE SERVICES, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES (INCLUDING, BUT NOT LIMITED TO, SERVICES FROM PRACTITIONERS) WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES (INCLUDING, BUT NOT LIMITED TO, SERVICES FROM PRACTITIONERS) WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

TO THE FULLEST EXTENT PROVIDED BY LAW, The Health Nav Limited HEREBY DISCLAIMS AND EXCLUDES ALL WARRANTIES AND REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OR REPRESENTATIONS OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL The Health Nav Limited, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OR LOSSES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR LOSSES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE HEALTH NAV LIMITED SHALL NOT BE LIABLE FOR ANY ACTS OR OMISSIONS OF ANY PRACTITIONER.

THIS DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

You agree to defend, indemnify, and hold harmless The Health Nav Limited, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms or your use of the Services or your interactions with any Practitioner, including, but not limited to, your User Content (if applicable), any use of the Services' content, services, and products, or your use of any information obtained from the Services.

We may terminate or suspend your access to all or part of the Services, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11.1 We use your personal data as set out in our Privacy Notice. How we use any personal data you give us is set out in our Privacy Notice.

11.2 We do not share your personal data with Practitioners. If you wish to interact with a Practitioner, please contact them directly using the contact details displayed on our website or mobile application. Where you interact with a Practitioner they will be a data controller of the personal data you provide to them and their privacy policy will apply to their processing of that data. The Practitioner is a third party and they will be responsible for the personal data they process about you as a controller, and you should review their privacy policy before you share any personal data with them to ensure you are comfortable with who they are and how they will use your personal data. We are not responsible or liable for the data controller related acts or omissions of Practitioners.

These Terms and any dispute or claim arising out of, or related to, them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of England and Wales, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Services thereafter. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

No waiver by The Health Nav Limited of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure or delay of The Health Nav Limited to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

These Terms constitute the sole and entire agreement between you and The Health Nav regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
